V24-0008 Public Hearing - Vacate Petition by East Sun, LLC and West Sun, LLC to vacate a portion

of improved deeded public right-of-way known as Baptist Church Road in East Lake Orient Park,

abutting Folio Nos. 062651-0000, 062670-0000, 040588-0000, 040587-0000, 040589-0000.

(a) Adopt a Resolution vacating a portion of improved deeded public right-of-way known as Baptist Church

Road, consisting of approximately 24,151 square feet (0.554 acres).  (b) Accept a Drainage and Public

Access Easement from East Sun, LLC and West Sun, LLC at the request of staff to ensure the County’s

ability to maintain existing stormwater infrastructure and ensure public access to and from the rights-of-way

lying north and south of the vacate area. The petitioners, East Sun, LLC and West Sun, LLC, submitted

this request to allow for more efficient redevelopment of their property. As conditions of no objection,

Florida Department of Transportation requested that the most northern portion of Baptist Church Road not

be vacated in anticipation of a potential I-4 expansion and TECO requested a private easement over the

vacate area. Additionally, staff confirmed with a neighboring property owner to the south that their current

access will not be impacted (as further explained in the background), and Public Works confirmed there is

no reimbursement required for the existing right-of-way. All other reviewing departments, agencies, and

and utility providers have raised no objections. Estimated costs for required advertising per statute, recording

fees, and processing, are accounted for in the Petitioner’s application fee of $400.
