Title: Public Hearing - Vacating Petition by Impact Apollo Beach Ventures, LLC, Apollo Beach Property LLC, and Park Square Enterprises, LLC to vacate a portion of the plat of Apollo Beach Unit Six, including portions of unimproved rights-of-ways known as Gulf and Sea Boulevard and Chestnut Drive in Apollo Beach. LLC, and Park Square Enterprises, LLC to vacate a portion of the plat of Apollo Beach Unit Six,

including portions of unimproved rights-of-ways known as Gulf and Sea Boulevard and Chestnut Drive

in Apollo Beach.

Adopt a Resolution vacating a portion of the plat of Apollo Beach Unit Six, as recorded in Plat Book 37,

Page 88, of the Public Records of Hillsborough County, Florida, consisting of approximately 492,182.86 square

feet (11.30 acres) and including portions of unimproved rights-of-way known as Gulf and Sea Boulevard and

Chestnut Drive. The petitioners, Impact Apollo Beach Ventures, LLC, Apollo Beach Property LLC, and Park

Square Enterprises, LLC, have submitted this request to replat the property with different lot sizes and right-of-

way widths. There are no objections to this vacate request. A Temporary Public Access and Utility Easement

(“Temporary Easement”) is being reserved over the right-of-way portion of the vacate area. The Temporary

Easement will automatically terminate once the petitioner’s proposed Hammock Bay replat is recorded which

addresses (i) a staff request to provide continuous legal access to all parcels adjacent to the right-of-way and (ii)

utility provider requests to maintain a utility easement in the vacate area. The Public Works Department has

reviewed the petition and confirmed no reimbursement is required for right-of-way improvements. Conservation

and ELAPP noted that the subject vacate area is adjacent to the County’s Wolf Branch Creek Nature Preserve

and approval of a compatibility plan by the Conservation and Environmental Lands Management Department

shall be required as condition of granting a Natural Resources Permit for any future development. Estimated

costs for required advertising per statute, recording fees, and processing are accounted for in the Petitioner’s

application fee of $400.
